These Terms of Service ("Terms") govern your access to and use of covenantstructural.com (the "Site"), operated by Covenant Structural ("Company," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.
1. Acceptance of Terms
By using this Site, you confirm that you are at least 18 years of age and capable of entering into a binding agreement. If you are accessing the Site on behalf of a company or organization, you represent that you have the authority to bind that entity.
2. Use of the Site
You agree to use the Site for lawful purposes only. You may not use the Site to: (a) violate any applicable law or regulation; (b) infringe on the intellectual property rights of others; (c) transmit harmful code or malware; (d) attempt to gain unauthorized access to any portion of the Site; or (e) interfere with the Site’s operation.
3. Service Information
The Site provides information about Covenant Structural’s commercial and industrial concrete services. Information on the Site is for general informational purposes and does not constitute a binding offer of services. Specific project terms, scope, pricing, and warranties are governed by separate written agreements between Covenant Structural and our clients.
4. Intellectual Property
All content on the Site — including text, graphics, logos, images, photographs, and the Covenant Structural name and logo — is the property of Covenant Structural or its licensors and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.
5. User Submissions
If you submit information to us through the Site (such as via the contact or assessment request form), you grant Covenant Structural a non-exclusive, royalty-free, perpetual license to use, reproduce, and process that information for the purposes of responding to your inquiry, providing services, and conducting normal business operations. You represent that any information you submit is accurate and that you have the right to share it with us.
6. Photo Uploads
If you upload photos to our assessment request form, you confirm that you own or have permission to share those images. You grant us permission to view, store, and use the images for the limited purpose of evaluating your project and preparing a written scope. We will not publish or distribute submitted photos without your separate consent.
7. Disclaimer of Warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, Covenant Structural disclaims all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Information on the Site about concrete repair methods, materials, and outcomes is general guidance and is not a substitute for site-specific professional engineering assessment. Project warranties offered by Covenant Structural are governed by separate written project agreements, not by these Terms.
8. Limitation of Liability
To the fullest extent permitted by law, Covenant Structural and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site shall not exceed one hundred dollars ($100).
9. Indemnification
You agree to indemnify, defend, and hold harmless Covenant Structural from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
10. Third-Party Links
The Site may contain links to third-party websites. We do not control, endorse, or assume responsibility for the content, privacy practices, or operations of any third-party site. Your use of third-party sites is at your own risk and subject to their terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Denver County, Colorado.
12. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on the Site, with the "Last updated" date at the top reflecting the most recent revision. Continued use of the Site after changes constitutes your acceptance of the updated Terms.
